Seriously is this the hope and change you wanted?

Is this the End of what our fathers fought and died to cre­ate for us, A Bet­ter Amer­i­ca?

Are we see­ing the destruc­tion of Amer­i­ca because of a small per­cent­age of out of con­trol Lib­er­als?

Per­haps you may have heard about job killing bills that Wash­ing­ton has cre­at­ed, with huge num­bers of unem­ployed, is it wise to pass bills that pre­vent small busi­ness com­pa­nies from grow­ing?

Small busi­ness dri­ve this econ­o­my, with­out the mil­lions of small busi­ness own­ers this nation would expire, This bill is Evil and must be defeat­ed, H.R. 1249  must be defeat­ed and those that signed it must be vot­ed out of office because they are as evil as this bill is evil, men that would sup­port this bill are not Amer­i­cans they are alleged, trash and not fit for office and should be recalled.

My Friends I received this in an email and it is dis­turb­ing, and not sur­pris­ing that we have a rad­i­cal crew, of indi­vid­u­als that are ded­i­cat­ed to allow­ing uncon­sti­tu­tion­al changes to the very fab­ric of our way of life, on the sur­face it may not seem like much, but when you real­ly look at what they are propos­ing in the Sen­ate we must stop this evil bill, that would effec­tive­ly put an end to the Amer­i­can Dream of being an inven­tor.

H.R. 1249  Will Kill our nation, it will destroy our way of life, it is fash­ioned after the Euro­pean style of gov­ern­ment, my friends this is not Europe, and per­haps it is time to send Wash­ing­ton a mes­sage that any­one who thinks they are liv­ing in Europe should leave now, because We the peo­ple know where we live, WE know our his­to­ry, it is time for this non­sense to stop, it is time to vote these dirt bags out of office, they are attempt­ing to sell our way of life right out from under our feet.

When will Amer­i­can learn…

It robs the Amer­i­can of every­thing that makes us free.

It is Abhor­rent and it comes from the Lib­er­al Con­trolled Sen­ate.

I urge you to con­sid­er what it would mean if only large cor­po­ra­tions con­trol patents, and inven­tions?

What would it mean if a large cor­po­ra­tion could patent the way that you spell your name, did you know that they could make you pay a fee every-time you signed your name, I know it sounds crazy and stu­pid, but if this is allowed to go through it will stop our econ­o­my dead in its tracts, for no one will ever want to try to invent any­thing any more.

Please take time to read this and please do what you can to spread the word this is the most dis­gust­ing thing I have read in a long time, and again under­stand that at first you may think it does not mat­ter but when you real­ly read what they want to do, you will under­stand that it favors large cor­po­ra­tions over Amer­i­cans, it favors law that was cre­at­ed out­side of Amer­i­can val­ues, it is not the Amer­i­can Way it is Uncon­sti­tu­tion­al and it is Evil.

While Wash­ing­ton is busy argu­ing loud­ly and slow­ly about gov­ern­ment shut­downs, Oba­ma and his allies in both par­ties are being awful­ly quick and qui­et about their plan to take away our Con­sti­tu­tion­al prop­er­ty rights and bail out their multi­na­tion­al cor­po­rate friends with tril­lions of dol­lars in new wealth trans­fers. The Orwellian name of this destruc­tive leg­is­la­tion is the “Amer­i­ca Invents Act” (H.R. 1249). We call it “Obama­P­atent.” It’s uncon­sti­tu­tion­al; it will harm small busi­ness and inno­va­tion; and it will destroy jobs.

They know you will find out about this leg­isla­tive scheme. So they’re skip­ping the usu­al House sub­com­mit­tee action on the bill and try­ing to ram this bill through the full com­mit­tee and the House before you know what’s hap­pen­ing.

The next day that Con­gress is open for busi­ness, call your Rep­re­sen­ta­tive.

U.S. House switch­board at (202) 224‑3121 and ask for your Rep­re­sen­ta­tive by name. Once you are con­nect­ed to the office, ask for the staff mem­ber who han­dles patents. Tell him/her that H.R. 1249 Amer­i­ca Invents Act is uncon­sti­tu­tion­al because it changes the patent sys­tem estab­lished in Arti­cle I Sec­tion 8 Clause 8 of the U.S. Con­sti­tu­tion. Tell them to keep Amer­i­ca’s Con­sti­tu­tion­al First-To-Invent patent sys­tem. Tell them you will be watch­ing their vote on H.R. 1249, the Amer­i­ca Invents Act. Tell them it’s time to stand up for the Con­sti­tu­tion and for the cre­ation of jobs we so des­per­ate­ly need.

Boy, he was­n’t kid­ding.

As his onslaught of gross­ly anti-Amer­i­can and pro-Euro­pean-style plans, poli­cies, and projects con­tin­ues, it’s hard to keep track of them all. Yet, here’s anoth­er, and here’s why this one real­ly mat­ters.

Oba­ma, his Demo­c­rat allies, and many “tenured” Repub­li­cans are work­ing with some of the world’s largest multi­na­tion­al cor­po­ra­tions to “har­mo­nize” Amer­i­ca’s patent sys­tem with those of Europe and Japan. They are try­ing to weak­en the Amer­i­can sys­tem (cur­rent­ly the best in the world) to match the sys­tems used by these for­eign coun­tries.

Just this week, Oba­ma’s patent chief, David Kap­pos, was at an inter­na­tion­al elit­ist meet­ing in Lon­don pro­claim­ing to the EU that the goal of the pro­posed Obama­P­atent sys­tem is “glob­al har­mo­niza­tion.” Kap­pos referred to our nation’s Con­sti­tu­tion­al patent sys­tem as “19th Cen­tu­ry” and “bizarre.” Sounds like Oba­ma’s glob­al apol­o­gy tour, but now they are apol­o­giz­ing for our Con­sti­tu­tion.

Why care about patents? If we Amer­i­cans can’t con­trol the fruits of our own inven­tions and tech­nol­o­gy, our coun­try will quick­ly become a tech­nol­o­gy and jobs back­wa­ter.

Intel­lec­tu­al prop­er­ty (e.g. patents, copy­rights) is the cur­ren­cy of the new econ­o­my.
But its cru­cial impor­tance to job cre­ation and growth was rec­og­nized long ago by our Found­ing Fathers.

When they wrote the Con­sti­tu­tion, the founders specif­i­cal­ly includ­ed the rev­o­lu­tion­ary idea of award­ing patents — not to the king’s favorites such as was com­mon prac­tice in Eng­land and else­where — but to the indi­vid­ual per­son who actu­al­ly came up with the inven­tion. This is known as the First-To-Invent patent sys­tem and was estab­lished by Arti­cle I Sec­tion 8 Clause 8 of the Con­sti­tu­tion, which states:

“To pro­mote the Progress of Sci­ence and use­ful Arts, by secur­ing for lim­it­ed Times to Authors and Inven­tors the exclu­sive Right to their respec­tive Writ­ings and Dis­cov­er­ies.”

The founders’ rad­i­cal First-To-Invent approach to patent awards instan­ta­neous­ly lev­eled the play­ing field between the lit­tle guy build­ing the dream tech­nol­o­gy of tomor­row in his work­shop or garage and the giant, entrenched, multi­na­tion­al cor­po­rate inter­ests that always seek to damp­en dis­rup­tive inno­va­tion to pro­tect their dom­i­nant mar­ket share. By award­ing patents to the actu­al inven­tor, our Found­ing Fathers incen­tivized inno­va­tion by and for every­one and unleashed the Amer­i­can know-how that has helped pow­er our coun­try’s eco­nom­ic and mil­i­tary suc­cess for over 224 years.

Who ben­e­fits most from Amer­i­ca’s Con­sti­tu­tion­al First-To-Invent patent award sys­tem? The lit­tle guy, the small, medi­um and inde­pen­dent busi­ness­es, the inno­va­tors, Amer­i­ca’s mid­dle class, the peo­ple who, lit­er­al­ly, fought for and built this coun­try and made it great, the peo­ple who live in and are loy­al to this coun­try. (Come to think of it, I just described the grass­roots of the TEA Par­ty move­ment).

Under Obama­P­atent, the U.S. will adopt the Euro­pean sys­tem and award the patent to the first enti­ty to file a claim to new tech­nol­o­gy. Giv­en the cost, com­plex­i­ty, and delay of the patent fil­ing process, Obama­P­atent will tilt the play­ing field sharply in favor of large, multi­na­tion­al, entrenched busi­ness inter­ests. Then, Amer­i­ca’s tech­nol­o­gy, indus­tries, and jobs will move even more quick­ly over­seas.

In this mas­ter stroke, Oba­ma rewards his large cor­po­rate donors (think Gen­er­al Elec­tric, which is a big pro­po­nent of Obama­P­atent) with a cheap­er and eas­i­er way to steal Amer­i­can tech­nol­o­gy and take it over­seas. And, Oba­ma simul­ta­ne­ous­ly under­cuts the small and inde­pen­dent busi­ness peo­ple who are the core of the TEA Par­ty and reduces pri­vate sec­tor man­u­fac­tur­ing jobs, thus forc­ing more vot­ers into gov­ern­ment employ­ment, onto the dole, and into Oba­maCare. And he gets to weak­en Amer­i­ca’s econ­o­my and mil­i­tary, all at the same time. Bril­liant!!

The great major­i­ty of legal schol­ars who have exam­ined Oba­ma’s First-To-File patent sys­tem have con­clud­ed that it vio­lates Arti­cle I Sec­tion 8 Clause 8, and that Obama­P­aten­t’s First-To-File sys­tem is uncon­sti­tu­tion­al. No schol­ar has yet assert­ed that Oba­ma’s First-To-File sys­tem is con­sti­tu­tion­al. But, as I re-dis­cov­ered two weeks ago in my first trip back to DC in 20 years, Con­gress does­n’t care much about what the Con­sti­tu­tion says.

Like Oba­maCare, Obama­P­atent is an uncon­sti­tu­tion­al and unholy alliance between big gov­ern­ment and big busi­ness harm­ing the rest of us.

This leg­is­la­tion is mov­ing fast. It has already passed the Sen­ate and its House equiv­a­lent, H.R. 1249, is mov­ing quick­ly. Many GOP mem­bers are help­ing Oba­ma with his plan.

There’s no time to lose. Ana­lysts agree that the only ones who can stop Obama­P­atent now are Amer­i­ca’s Con­sti­tu­tion­al con­ser­v­a­tives and TEA Par­ty cit­i­zens like you and me.

Please pass this infor­ma­tion on to your fam­i­ly, friends and fel­low cit­i­zens. Ask them to join us in stop­ping this uncon­sti­tu­tion­al, multi­na­tion­al pow­er grab and jobs destroy­er.
