(CNN)U.S. Supreme Court Jus­tice Antonin Scalia, the lead­ing con­ser­v­a­tive voice on the high court, has died at the age of 79, a gov­ern­ment source and a fam­i­ly friend told CNN on Sat­ur­day.

There are a lot of opin­ions out there and many are not cor­rect, how­ev­er what does hap­pen if the usu­al 5–4 vot­ing is now in doubt.

His death set off an imme­di­ate debate about whether Pres­i­dent Barack Oba­ma should fill the seat in an elec­tion year. Oba­ma said Sat­ur­day night that he plans to nom­i­nate a replace­ment, but Sen­ate Major­i­ty Leader Mitch McConnell said the nom­i­na­tion should wait until the next pres­i­dent comes into office while top Demo­c­rat Har­ry Reid called for the seat to be filled “right away.”

Cer­tain­ly there may be some the­o­ries which obvi­ous­ly should be ruled out.

how­ev­er the main ques­tion is one that could effect cur­rent pol­i­tics for many years to come.

Speak­ing while on a pres­i­den­tial trip to Ran­cho Mirage, Cal­i­for­nia, Oba­ma vowed to nom­i­nate a suc­ces­sor to Scalia, who he called “a tow­er­ing legal fig­ure.”

“There will be plen­ty of time for me to do so and for the Sen­ate to ful­fill its respon­si­bil­i­ty to give that per­son a fair hear­ing and a time­ly vote,” Oba­ma said. “These are respon­si­bil­i­ties that I take seri­ous­ly, as should every­one. They’re big­ger than any one par­ty. They are about our democ­ra­cy. They’re about the insti­tu­tion to which Jus­tice Scalia ded­i­cat­ed his pro­fes­sion­al life.”

There is cer­tain­ly going to be a huge fight over whom will be replac­ing Jus­tice Scalia.

Cur­rent­ly, no one knows who will be nom­i­nat­ed how­ev­er it appears that from past expe­ri­ence the nom­i­nee is like­ly to be unqual­i­fied.

It is almost an in your face type moment, but who knows for sure, one thing seems clear, in an admin­is­tra­tion where more law­suits have been filed than any oth­er admin­is­tra­tion in his­to­ry, (opin­ion, but it cer­tain­ly seems fair to say that the con­tentious law suits filed already would tend to demon­strate the truth behind the lies)
