Activist Judge

It would seem that many of these Judges have decid­ed that they can do any­thing they want to do and noth­ing hap­pens.

This might seem like these judges just make up these legal the­o­ries out of thin air and that actu­al­ly seems to be the case.

This is com­mon­ly called Activism and it is a sit­u­a­tion that should not hap­pen for many rea­sons but the biggest rea­son is like­ly the fact that the Law works because of a series of past events where pre­vi­ous­ly deter­mined legal argu­ments have been applied in court.

These legal the­o­ries often are devel­oped over many years.

When a lawyer enters into court it is his or her job to argue a legal the­o­ry that is then adju­di­cat­ed by a jury or a judge.

The prob­lem with what has been hap­pen­ing recent­ly is that these judges are argu­ing a the­o­ry that has nev­er been adju­di­cat­ed before.

This is some­thing that almost nev­er hap­pens or hap­pens so infre­quent­ly that pre­vi­ous decid­ed legal the­o­ry is almost nev­er changed over time.
